Minimum Advertised Price Policy

For authorized sellers, resellers, sales representatives, or distributors (singular, “Seller,” plural, “Sellers”) of GenuinePurity (“GP”; also, “we,” “us,” or “our”), products (“the Products”), we have established a Minimum Advertised Price (“MAP”) Policy (“MAP Policy”).

  1. In order to preserve the premium reputation of the Products and the GP brand, avoid a race to the bottom based on price which hurts all Sellers, and encourage value-added measures/services which make you more competitive and improve customer satisfaction, we hereby set a MAP, i.e., the lowest price at which a Product can be advertised.

  2. The MAP policy applies online and offline, across all sales channels.

  3. To ascertain the minimum price for which a specific Product may be advertised, please contact partners@genuinepurity.com.

  4. The MAP and the MAP Policy may be amended at any time by GP in its sole discretion.

  5. The MAP shall be used in any and every advertising medium. This includes seller-initiated emails and texts, pay-per-click ads, online product ads, paid search ads, display ads, mobile ads, banner ads, product listing ads, blogs, social media, sponsored links, outdoor signage, affiliate marketing networks, comparison shopping engines, mobile or smart phone applications, postal mail solicitations, printed materials (such as flyers, posters, catalogues, brochures, and ads in periodicals), coupons, TV, radio, telephone solicitations, or advertising in any other media and format whatsoever. This does not apply to end-pricing or displays in brick-and-mortar establishments, but it does apply to pricing listed on materials that are available to customers to remove from the premises.

  6. The MAP does not impose a ceiling to pricing.

  7. The MAP may not appear with a strike through or other alteration in advertising such as to convey the impression that it is not the pricing.

  8. No third-party may alter the pricing on your behalf, nor may there be other indirect attempts to circumvent the MAP Policy.

  9. If GP offers Products on sale to Sellers, the MAP will be the sale price for all Sellers for the duration of the sale.

  10. “See price in cart” messages or similar verbiage online that implies the availability of a price lower than MAP is considered advertising that violates the MAP Policy.

  11. You may not offer any of the Products in advertising in conjunction with discounted or free non-GP products, which would in effect have the result that the advertised pricing for the Product(s) is below MAP.

  12. The MAP Policy is a unilateral policy, applying equally to all Sellers, has been determined without input from any specific Sellers, is not negotiated, and is not an agreement between us and Sellers. Each Seller must independently decide to adopt the MAP Policy, but if a Seller does not, we will discontinue to transact business with you.

  13. Violation of the MAP Policy by Seller shall be determined at the sole discretion of GP, and will make the Seller ineligible to purchase, distribute, and/or sell the Products; pending orders will be canceled.

  14. GP shall be entitled to pursue all applicable equitable and legal remedies for violations, in addition to termination of sales to you.

  15. GP may provide Sellers a chance to cure at its sole discretion.

  16. GP monitors compliance, and Sellers must disclose evidence of all advertised prices, upon demand.
